Shift CBI FIR in Sushant Singh Rajput case to Mumbai cops, Maha tells SC

The mysterious suicidal death of actor Sushant Singh Rajput became a triangular war in the Supreme Court between Mumbai police, Bihar and CBI as the Maharashtra told the SC that CBI had no jurisdiction to probe the incident as the state has not given consent for investigation by the central agency.

Since the incident has happened in Mumbai, the CBI FIR should be treated as a ‘Zero FIR’ and transferred to Mumbai police, which is capable of doing a professional investigation into the case, said the affidavit filed on behalf of Mumbai police by an inspector of Bandra police station.

The inspector, Bhushan Mhadev Belnekar, said “Bihar government’s decision to transfer probe into Patna FIR bristles with malafide as Bihar police had no jurisdiction to lodge FIR on an incident that has taken place in Mumbai and second, Bihar was not the state competent to recommend CBI probe under DSPE Act.”

He said Bihar police was hesitating to register FIR but it was done under pressure from Bihar chief minister Nitish Kumar. “It is submitted that registration of FIR at Rajiv Nagar police station in Patna, was politically motivated and due to extraneous reasons.” The police inspector said registration of FIR in Bihar for an incident in Mumbai violated the federal structure of the country and would lead to a chaotic situation if other states start following this pattern.
